PROFESSIONAL INFORMATION

Biographical Notes:

My areas of practice have been litigation, environmental and land use law, commercial law, real estate law, administrative law and, appellate practice. I have extensive experience in the area of litigation. I have handled a wide variety of cases from complex environmental law and land use cases involving over 50 parties to bid disputes, Florida Public Service Commission cases, professional regulation cases, and commercial litigation. I have practiced before Florida and federal trial and appellate courts and the Division of Administrative Hearings. I have been involved in nearly every facet of administrative law such as rulemaking and rule challenges, declaratory statements and adjudicatory proceedings. In my practice, I have represented a wide variety of clients such as Florida Power & Light and Georgia Power, environmental and neighborhood groups, governmental bodies, individuals seeking professional licensure and pro bono clients. I was appointed by Governor Chiles as the Chairman of the Florida Elections Commission from 1994 to 1998. In that capacity, I presided over a number of Section 120.57(1) hearings as well as Section 120.57(2) informal proceedings. I was also appointed by Governor Chiles to the Second Judicial Circuit Nominating Commission.

For the past 12 years, I have been involved in hundreds of alternative dispute resolution proceedings mostly as a mediator. I have been involved as a mediator, arbitrator or facilitator with, among others, the United States Army Corps of Engineers, United States Fish And Wildlife Service, United States Department of Justice, United States Environmental Protection Agency, South Florida Water Management District, St. John s River Water Management District, Everglades National Park, Hillsborough County, Florida Department of Environmental Protection, Florida Department of Community Affairs, Florida Department of Transportation, City of Naples, City of Key West, City of Maitland, Bonita Springs, Cape Coral, Charlotte County, Hernando County, Orange County, Martin County, Walton County, Wakulla County, City of Port St. Lucie, Miami-Dade County, Okaloosa County, St. Lucie County, Martin County, Gadsden County, City of Tallahassee, Leon County, City of Jacksonville, Neptune Beach, Tampa Bay Water Authority, Jacksonville Port Authority, Florida s Board of Trustees of the Internal Improvement Trust Fund and numerous private clients ranging from neighborhood groups and environmental groups to business entities.

I have been retained to be a Special Magistrate pursuant to Section 70.51, Florida Statutes, by the City of Neptune Beach, City of Jacksonville (two times), Nassau County, Hernando County, St. Lucie County, Pasco County (two times), Southwest Florida Water Management District, Department of Environmental Protection, Gadsden County, Walton County and the private parties involved in those proceedings.

From 2002 to 2005 I was one of the two Florida-based mediators/facilitators working on Everglades restoration issues for the U. S. Institute for Environmental Conflict Resolution. Based on qualification and experience, I have been selected to the roster of the U.S. Institute for Environmental Conflict Resolution, the federal agency created by Congress to provide dispute resolution services for matters involving federal agencies. Roster membership selection is based on background and extensive experience in the field of alternative dispute resolution involving land use and environmental issues. I was also selected to be a mediator for the State Agency Dispute Resolution Pilot Project.

RATES & PAYMENT INFORMATION

Rates: Hourly fee is $300 charged in 1/10th hour increments for the mediation conference and preparation (review of mediation statements and relevant documents.) If more than 3 parties, the hourly fee is $350. There is standard mileage cost (federal rate) fee for travel and all other costs are charged at cost to me. There are no meal charges. There are no copying or fax charges unless excessive and you approve of them ahead of time. There is no hourly fee for travel but a flat fee of 1 hour maximum for round-trip travel 30 miles from Leon County. Please call for further details.

Payment: Payment due within 45 days of billing and a 10% surcharge added to amount due if not paid within 60 days of billing or if other arrangements have not been made.

Cancellation Policy: No cancellation fee if mediation is canceled 24 hours ahead of the mediation date; otherwise a 2 hour fee is charged. If cancellation is based on the parties settling the matter or a personal or professional emergency there is no cancellation fee.
