Biographical Notes:
 David is an experienced attorney whose work is substantially devoted to the mediation and arbitration of commercial litigation and securities arbitration matters. David is engaged regularly by plaintiffs and defendants and mediates and arbitrates cases throughout the United States and in Puerto Rico. He has mediated and arbitrated more than 1,000 matters and has also served as a special master and as a special investigator in corporate derivative actions in state and federal court.
David is certified by the Florida Supreme Court as a Certified Civil Circuit and County Court mediator, and by the United States District Courts for the Southern and Middle Districts of Florida as a Certified Mediator and is listed in the Register of Mediators for the United States Bankruptcy Court for the Southern District of Florida. He is also a member of the Commercial Panel of Arbitrators and is a mediator for the American Arbitration Association and is an approved mediator for the Financial Industry Regulatory Authority. He was appointed in 2010 by the United States Bankruptcy Court for the Southern District of Florida as one of four mediators to mediate 1,400 preference actions in a large bankruptcy case. David was also appointed in 2010 as the Claims Resolution Arbitrator in the GunnAllen Financial bankruptcy pending in the Middle District of Florida.
Additionally, David is a member of the Florida Academy of Professional Mediators. The particular substantive areas in which he has mediated, arbitrated, litigated and served as a special master include securities, real estate, contracts, common law breach of fiduciary duty and fraud, legal professional liability, trade secrets, trademark and copyright infringement and counterfeiting, covenants not to compete, tortious interference, civil forfeiture, franchises, dealer termination, antitrust, civil rights, False Claims Act, probate, RICO, ADA, RESPA, Truth in Lending Act, insurance, corporate derivate disputes, class actions and other common law and statutory business torts.
David graduated with honors from Brandeis University and received his law degree with honors from Georgetown University Law Center where he participated on the Editorial Board of the American Criminal Law Review. Following graduation, David served as law clerk for the Hon. Howell W. Melton, United States District Judge for the Middle District of Florida. After his clerkship, David worked for nearly five years as an Assistant United States Attorney for the Southern District of Florida in Miami, Florida, in the appellate, civil, and major crimes and frauds divisions, and tried numerous civil and criminal jury trials. After leaving the U.S. Attorney's office, David practiced with the Kenny Nachwalter law firm for 14 years before establishing David Lichter & Associates, P.A. in 2003 and Higer Lichter & Givner in 2006.
David is a past Vice-Chair of the Securities Litigation Committee of the Dade County Bar Association, and is a past Chair of the Florida Bar's Federal Court Practice Committee. He has lectured on a variety of topics over the years (most recently 2009) at the Annual Conference hosted by the Florida Dispute Resolution Center and spoken on mediation at the ABA Section of Dispute Resolution Annual Conference and the Annual Seminar of the Securities Industry Association Compliance and Legal Division. David, who is A/V rated by Martindale-Hubbell, is included in the 2011 editions of The Best Lawyers in America in the specialty of Alternative Dispute Resolution, the 2011 Florida Trend Magazine's Legal Elite in the field of Mediation and in the 2010 Florida Super Lawyers Magazine in the field of Business Litigation and Mediation. His most recent article on mediation, "A Practical Path Towards Better Mediations," may be found in the Winter 2007 American Association for Justice Magazine.

RATES & PAYMENT INFORMATION |
Rates: - $425.00 per hour, including review time
- $275.00 per hour for travel
- No minimums
- Flat rates are available for mediations conducted out of state or outside the Miami-Dade-Broward-Palm Beach County area

Cancellation Policy: - For any mediation cancelled within ten days prior to the mediation, there will be a cancellation fee of up to 4 hours. Cancellations prior to the ten day period must be received in writing. The cancellation fee will be waived if we are able to reschedule another mediation for that time slot.
