Biographical Notes:
 Edward J. Kinberg - Attorney, Certified Mediator and Qualified Arbitrator
Mr. Kinberg devotes approximately 50% of his time to serving as a mediator and 50% of his time representing clients as an attorney. He was certified as a Circuit Court and County Court mediator in the State of Florida in June 0f 2001 and as a Qualified Arbitrator in the State of Florida in 2003. Mr. Kinberg is also a Board Certified Construction Attorney and a Fellow of the National Contract Management Association.
Mr. Kinberg’s law practice is focused on representing clients involved in construction and commercial transactions/litigation, contracting with the United States Government, state and local governments, and real estate transactions. He assists clients in all aspects of the contracting process such as contract formation, challenging awards, interpreting terms and conditions, preparing and submitting claims and litigating complex disputes before Federal Courts, and Federal and State Agencies. As a mediator his practice is limited to the same areas.
After graduating from Law School, he became an attorney with the Judge Advocate General's Corps
of the United States Army. During the first half of his military career, Mr. Kinberg served as criminal defense counsel, a prosecutor, a magistrate judge and a military law instructor at the U.S. Army Armor school. The remainder of his career was devoted to contract litigation and law. During that time he served as a trial attorney representing the Army in complex contract disputes and bid protests throughout the United States, as the Deputy Chief of Contract Law and Procurement Fraud Coordinator for the U.S. Army Europe and as a Senior Contract Law Advisor for the U.S. Army
Aviation and Troop Command.
Mr. Kinberg moved to Florida in 1994 and joined the law firm of Dugan and Dugan, P.A then opened
his own practice in 1996.
During the time Mr. Kinberg worked with Dugan and Dugan, he assisted Mr. Dugan in representing
the Melbourne Area Association of Realtors, individual realtors and individuals buying and selling homes. He also represented clients involved in public and commercial contracting disputes before the Court of Federal Claims, various district federal courts, state courts and various state and federal administrative agencies, including bid protests before the General Accounting Office.
Upon opening his own practice in 1996, Mr. Kinberg focused his practice on Government Contract Law, Construction Law and Commercial Law. In addition, Mr. Kinberg continues to represent realtors and individuals buying and selling homes. He also represents individuals in disputes involving the purchase or sale of homes. In that regard, his cases include a variety of issues ranging from disputes involving the terms and conditions of the sale as well as suits to enforce the terms of a contract.
In addition to serving his clients as an attorney, Mr. Kinberg is active in a number of associations that support his client's businesses. The National Contract Management Association (NCMA) has bestowed fellow status upon him in recognition of his contributions to the Federal Contracting Profession. In addition to serving as a speaker at numerous educational seminars sponsored by NCMA, he served as the President of his local Chapter, as the National Vice President for the Southeast Region and on the National Board of Directors and Executive Committee.
He has also served as the President of his local chapter of Associated Builders and Contractors (ABC) and is active in its legislative activities. He was appointed by the Secretary of Education for the State of Florida to serve on the Building Construction Industry Advisory Committee (BCIAC) for the State of Florida and served as the Chair of the BCIAC for two years. Mr. Kinberg is the founder of the Construction Industry Advisory Board at the Florida Institute of Technology (FIT) and is responsible for the establishment of a Construction Management Degree Program at FIT. He also serves as an adjunct professor at FIT.
Mr. Kinberg is also active in the Melbourne/Palm Bay Chamber of Commerce, where he has served
on the Board of Directors and the Chair of the Chamber’s Education Foundation. Mr. Kinberg was
responsible for developing a partnership between the Chamber and Melbourne High School to
establish the Academy of Business and Finance at that school and a second partnership with Palm Bay High School to establish the Academy of Construction and Design.
Mr. Kinberg provides mediation training and mediation services through the Dispute Resolution and Education Center and Florida Mediation Associates. He also serves as an arbitrator through Florida Arbitration Associates. In 2004, Mr. Kinberg was selected by the Collins Center for Public Policy, Inc. to serve as a mediator in the Florida Hurricane Mediation Program established by the Florida Department of Financial Services
Mr. Kinberg has published numerous articles on various areas of interest to the Construction Industry and the Government Contracting Industry in addition to teaching seminars.

RATES & PAYMENT INFORMATION |
Rates: Hourly Fees: $275.00 per hour for mediation or arbitration.
Preparation time: For mediations, no charge for preparation time. For arbitrations all services, including preparation, adminstrative conferences, and study time are billed at the above rate.
Travel time by car: No charge for sessions held within 90 minutes driving time of Melbourne, Florida. For all other matters, there is a two hour charge for all travel time.
Travel Time by Air: All costs of Air Fare and a two hour charge for all travel time.
Minumum Service: All mediations or arbitrations must be scheduled for no less than 2 hours. Once a session is started, there is a minimum charge of 2 hours.

Payment: $275.00 due five days prior to the scheduled date of the mediation. Remainder Due within 5 days of completion of mediation.

Cancellation Policy: If a session is cancelled at least 3 working days before the scheduled date, there is an administrative cancellation fee of $275.00.
If a session is cancelled within 3 working days of the scheduled date, each party will be responsible for their pro rata share of the time reserved. For example, if three hours are reserved, the cancellation fee will $412.50 for each party.
