Biographical Notes:

Mr. Wagner is President of Wagner Resolution Services, an alternative dispute resolution firm with offices in the Orlando, FL and Pittsburgh, PA. He has served as a mediator or arbitrator in hundreds of cases since he entered the dispute resolution field in 1991, including, among others, employment, personal injury/wrongful death, comercial, banking, debtor/creditor, education, construction, product liabilty, professional liability, securities, real estate, landlord/tenant, land use, environmental, wills and trusts, insurance coverage and shareholder/partnership disputes. He has conducted mediations and arbitrations throuhout Florida, as well as in  PA, OH, NY, VA, D.C., GA, WV, MD, NC, AL and MS.

Mr. Wagner has received extensive mediation and arbitration training from the American Arbitration Association, the Harvard Project on Negotiation, the Cornell University Industrial Relations School, the Florida Dispute Resolution Center, the Usery Institute at Georgia State University, ABA Labor/Employment Section, FMCS.NMB ,NAA FINRA, FL Dept of Fimance and NYSE. He has also taught interactive course in mediation and arbitration as an adjunct professoe of law at the University of Florida college of Law.

Before becoming a full-time mediator, arbitrator and ADR consultant, Mr. Wagner spent many years as a litigator of  labor, employment, commercial, securities, construction, government contracts, trademark, products liability, professional liability, intellectual property, environmental, dealership/distributorship, franchise, trade secret, lender liability, wrongful death, personal injury, nursing home, toxic tort, real estate, land use, landlord/tenant, condominium association, business tort, defamation,  bankruptcy, trade regulation, antitrust, insurance coverage/ bad faith, shareholder/partnership and probate, including class and collective actions, for major law firms in Orlando, Pittsburgh and Boston, with brief respites to serve as a law professor at the University of Florida and Deputy Assistant General Counsel for the EEOC in Washington, D.C. He has been lead litigation counsel for plaintiffs and defendants in hundreds of cases in the federal and state courts, before administrative agencies and arbitration panels, including multi-party and class actions. In the course of such litigation. Mr. Wagner has negotiated the settlement of plethora of cases, with and without the assistance of mediators, as well as numerous business and collective bargaining agreements. In addition to being admiited to the bars of FL, PA and MA, he is admiited to practice before the federal district courts in those states as well as to the U.S.Courts of Appeal for the First, Third, Fourth, Fifth, Nineth and Eleventh Circuits, and the U.S. Supreme Court, FL Public Utility Commission and U.S. Trademark Office

RATES & PAYMENT INFORMATION

Rates:
LABOR-MANAGEMENT DISPUTES: $975 per diem. Covers 8-hour hearing day, including lunch and breaks. Not prorated for hearing of less than 8 hours; Study and travel time prorated per diem; reasonable expenses are charged at cost, such as transportation, parking, lodging, meals.

REGULAR ARBITRATIONS AND MEDIATIONS: $325 per hour;, including study and travel time; reasonable expenses are charged at cost, such as transportation, parking, lodging and meals.

Payment: Payment due upon receipt of invoice. While it is understood that amount charged on invoice may be subject to reimbursement from your client, or forwarded to your client for direct payment, please understand this engagement has been accepted in reliance upon my profesional relationship with you and your firm. Should you or your firm not agree to assure timely payment, please advise in writing, together with the name and contact information of the financially responsible client representative, so I may invoice your client directly, for a security deposit.

Cancellation Policy:
LABOR-MANAGEMENT DISPUTES: One day per diem for each day of scheduled hearings, plus any nonrefundable expenses incurred to date, if less than fifteen (15) days written notice of cancellation or postponement.

REGULAR ARBITRATIONS AND MEDIATIONS: Eight (8) hours at hearing/study time rate ,plus any preparation time and nonrefundable expenses incurred to date, if less than fifteen (15) days wriiten notice.
