Biographical

Alternative Dispute Neutral committed to impartiality, excellence, and integrity with over 22 years of combined judicial experience as a trial and appellate judge; and 8 years’ experience as a neutral arbitrator/mediator/special master. Selected to serve as the sole, chair and/or panel member for approximately 100 arbitrations involving, but not limited to, the following type matters: International ADMIRALTY/MARITIME TORT Claims; CONTRACTUAL-complex general commercial disputes, the largest of which to date has involved a forty-three million dollar claim and counterclaim between a Florida hospital and the wholly owned subsidiary of a London-based international pharmaceutical manufacturer; EMPLOYMENT-discrimination, trade secrets, restrictive covenants, wrongful discharge, ERISA, benefits, sexual harassment, etc.; FRANCHISE-breach of trademark, non-compete provisions, unfair and deceptive trade practice act violations, Robinson-Patman Act violations, exclusivity provisions, failure to use proprietary products, etc.; HEALTHCAREpayor/ payee and managed care issues, fair hearings, medical billing/reimbursement disputes, etc.; INSURANCE-bad-faith claims, the largest of which to date has involved a sixty-five million claim; business interruption/property loss, agency/broker issues; claims management practices, claims service agreements, large deductible/self-insured retention programs, premium/collateral obligations, insurance regulatory matters, insurance coverage, directors & officers insurance, ERISA, fiduciary liability insurance, mortgage insurance, worker compensation insurance, fidelity insurance, professional liability insurance, errors and omissions insurance, allocation of loss among multiple insurers, primary/excess issues, trigger issues and number of occurrences, exhaustion of policy limits, toxic torts and hazardous wastes coverage, professional liability coverage, and employer liability coverage; INTELLECTUAL PROPERTY-copyright, trademark infringement, piracy and fair use issues; REAL ESTATE-brokerage, commissions, appraisals, acquisitions, sales leases, mortgages, and title insurance; SECURITIES-suitability, diversification, risks assumed and broker disputes. Has mediated more than 100 general civil matters including, but not limited to, disputes involving commercial, bankruptcy Ponzi scheme, constitutional voters’ right issue, foreclosure actions, employment, healthcare, tort, insurance, real estate, and franchise matters. The largest of such mediations to date has resulted in the settlement of a multimillion-dollar deficiency judgment dispute between various Latin American partnerships/corporate entities and a Florida financial institution.
